f Former Colorado Bureau of Investigation (CBI) agent and current Crowley County Sheriff's Office Undersheriff Mark Morlock testified the majority of the day Tuesday before jurors in relation to the 2012 death of Byron Griffy.Morlock, who was the lead investigator for CBI Oct. 12, 2012, the date on which Griffy was found with a single, fatal gunshot wound to the back of his head, was responsible for the investigation and eventual arrest warrant issued against murder suspect Anthony Wright.Morlock, questioned almost entirely by prosecutor Jim Bullock Tuesday, said the arrest was based off of discrepancies in Wright's alibi, primarily the vehicle Wright and Charles Giebler, since deceased, claimed to be driving the day of Griffy's death.As previously testified, both Wright and Giebler followed through with previous plans to visit Griffy the afternoon of Oct. 12, 2012 for a lunch date, and, later revealed by Morlock and by Wright and Giebler through recorded questioning, to return a safe to Griffy.According to Wright and Giebler, both initially interviewed Oct. 13, 2012, they drove a 1997 black Mercedes S500 from their home in Florence to Fowler Oct. 12 and spoke to Griffy before leaving home and again as they passed through Pueblo.The pair claim they planned to meet Griffy at a farmhouse he owned east of Fowler, but when they arrived, were unable to access the farmhouse because of a locked gate. Giebler called Griffy from the gate, confirmed by phone records, before driving back to Fowler. According to Wright and Giebler, they drove around the town of Fowler for roughly 15 minutes, called Griffy again and headed to Pueblo just before 1 p.m., where they stopped for lunch at Country Buffet and then at Home Depot to purchase a deck box for their boat at Pueblo Reservoir.Receipts provided by Giebler confirmed that the two arrived at Country Buffet in Pueblo at 2:26 p.m. and purchased the deck box from Home Depot at 3:07 p.m.Wright, during the initial interview, and twice after, claimed to place the deck box, roughly six feet by three feet, in the back seat of the Mercedes. Giebler, in all three interviews, confirmed that Wright placed the deck box in the Mercedes, either in the back seat or trunk.On their way home, Wright said the two stopped at a marina at the Pueblo Reservoir to drop off the deck box. Giebler made no claim, instead saying the two returned home to Florence.During testimony, Morlock expressed concern that neither Wright nor Giebler made any effort to contact Griffy, 75, after leaving Fowler as they were aware of his health conditions and made no effort to inquire about his whereabouts. Additionally, Morlock made note of roughly one hour of "lost time" between Wright and Giebler leaving Fowler and arriving at Country Buffet, a trip that he estimated to take 38 minutes, but rather took the pair roughly 1 1/2 hours.Page 2 of 4 - According to Wright, who responded to the time frame during a second interview, the two were indecisive as to where they wanted to stop for lunch and drove to Pueblo West before turning around and driving back to Pueblo to go to Country Buffet. Giebler always claimed the two went directly from Fowler to Country Buffet.Furthermore, Morlock said that Wright and Giebler's exact location was difficult to track and only became apparent after video surveillance from Home Depot showed the two exit and re-enter a white Astro van, not a black 1997 Mercedes S500."That became a significant issue. That was the day after," said Morlock, who testified the two were not initially questioned as suspects, but rather witnesses as Giebler was the last to speak with Griffy.Morlock said when questioned a second time about the vehicle they were driving, Wright responded, "absolutely" when asked if he was certain they were in the Mercedes.Both Wright and Giebler were again questioned Jan. 20, 2013, after Wright and Giebler, who were involved in a homosexual relationship, separated that evening. Wright, who was involved with and later married a woman who had been the wife of a close friend, left a note, along with his wallet, cellphone and keys at the home he and Giebler shared and vanished.Fearing the note referenced a possible suicide, Giebler called the Florence Police Department, who later located Wright near a river with a gun in his possession, transported him to the Florence Police Department and called Morlock under the assumption that the note and separation may be related to the October 2012 incident.During questioning, Morlock testified that he initially inquired about the apparent suicide note to both Wright and Giebler, a tactic he regularly uses to ease into other investigations.Wright, who claimed the note was not related to a suicide, but instead a way to separate himself from Giebler, was again questioned about Griffy's death and any relation he or Giebler had, and testified again that two two went to Fowler in a black 1997 Mercedes S500."He was specific once again," said Morlock. "Even when asked again about the massive deck box, he said he put it in the Mercedes."When finally confronted about the white Astro van, Wright responded, per video evidence presented before the court, "I don't know what you're talking about."Asked by Morlock, "Why are you not being honest?," Wright replied, "I could have swore I was in the black car.""I took his deception to be quite significant," said Morlock during testimony. "They were in a 2-seat Astro van. And if they were taking Byron to lunch, where was he even going to sit? It was a concern to me. Once I knew what vehicle they were driving, things changed in my mind."Page 3 of 4 - When questioned about a large collection of money and collectibles Wright and Giebler admittedly were storing for Griffy and the discrepancies with Griffy's family pertaining to what was in their possession, Wright claimed that Griffy had sent someone to pick them up."He (Griffy) had somebody show up and take them," said Wright. "Somebody came from up north."During the recorded interview with Giebler, Morlock also asked about the vehicle the two were driving in the day of Griffy's death and the discrepancies in his story related to previous interviews.When asked whether he and Wright drove straight from Fowler to Country Buffet, Giebler responded, "It seems like we did. I don't know. I'm having a bad day." When questioned about the vehicle he and Wright drove to Fowler Oct. 12, Giebler said," I could have swore we took the Mercedes," and when pressed again said, "Did we take the van? We always take the Mercedes but we may have taken the van. What were we in?"Questioned by Morlock why he couldn't remember what they drove, Giebler, becoming agitated, said, "My best friend is dead. I can't remember."Also questioned about the collectibles belonging to Griffy being stored in his home, Giebler said coins, not cash, were in his possession and said Griffy sold off some coins so that "some kid couldn't get them."As indicated by video, Giebler grew more irritated by questioning and at one point stood up, outside the frame of the video, telling Morlock to arrest him or let him leave.Remaining in the room however, Giebler made reference to the in which manner Griffy was murdered, saying he was upset that Griffy was put on his knees and shot execution style.Morlock, who testified that the manner in which Griffy was murdered had not been determined, questioned Giebler about his knowledge of Griffy's death, to which Giebler said that as a mortician and the owner of the funeral home that conducted Griffy's services, he could tell Griffy was shot in the head."I didn't do anything to Byron. I would never do anything to Byron," Giebler exclaimed.Asked who he thought murdered Griffy, Giebler responded, "I don't know. He was a gay man in a small town. ... He was a registered sex offender in a very small town. ... You don't think it bothers me knowing I was parked at the gate while he was probably being killed inside?"A search warrant was issued for the white Astro van on Jan. 23, 2013. Pictures of the interior, including the lack of a backseat were noted. Giebler was found deceased in his home two days later, Jan. 25, the apparent victim of heart failure.On Jan. 26, a search warrant was granted at the home of Giebler and Wright per the request of Morlock, who said he spoke with Griffy's daughter, Lynette. Lynette Griffy said she was at the home of Giebler and Wright Jan. 24 to retrieve her father's belongings, the majority of which she claims were not returned.Page 4 of 4 - Of note to Morlock was an approximate $37,000 in quarters, up to $750,000 cash and three envelopes Lynette says her father left for her and her two sisters which she earlier testified included enough funds to take care of her and her sisters in the event of her father's death.Pictures showing the items seized from the home of Giebler and Wright were shown to the jury, including 38 slides, some duplicates, the majority being coins and miscellaneous cash.During initial cross examination of Morlock, defense attorney Randall Jorgensen questioned whether Morlock was ever made aware of an apparent assisted suicide referenced by other witnesses who testified in days prior. As Morlock was unaware during investigation, Jorgensen outlined Griffy's discomfort with a sexual assault case he pleaded guilty to and his apparent desire to purchase a gun with the intent to hire a hit man to kill him."I was made aware very later on," said Morlock. "Recently. Within the last week or so."Questioned about the search warrant obtained to enter the home of Giebler and Wright, Jorgensen questioned whether Morlock was looking for any particular coin set, to which Morlock said he was only given a "general description.""So, the coins could have belonged to Anthony Wright?," questioned Jorgensen, since Wright was also a coin collector, to which Morlock responded, "One box had Byron Griffy's name on it."Asked whether or not he was aware if Wright and Griffy could have exchanged coins, Morlock responded, "I don't know," and when asked whether Lynette Griffy gave specificity of stamps that were also seized, Morlock said, "no."Jorgensen continued to ask about the search warrant, asking who was to later determine ownership of the coins.
